Dear Fellow LaPalme Residents,
The HOA board adopted several operating rules changes on September 1, 2026, which many of us feel are not in the best interest of the residents. These rule changes provide for broad discretionary decision-making by the board members, which will preclude residents from challenging their decisions. Therefore, per California Code Section 4365, we are petitioning the board to hold a membership-wide election to either reverse the changes to the rules or leave them in place.
Some examples of the rules we think are not in the best interest of the residents include:
INTERNAL AND ALTERNATIVE DISPUTE RESOLUTION, SECTION 6: If a resident fails to provide a 10-day notice that they will have an attorney present during the IDR, the board either reschedule the meeting or deem the IDR requirement fulfilled. In other words, the board can use the above as an excuse to claim an issue has been resolved.
ENFORCEMENT POLICY AND FINE SCHEDULE, PREAMBLE (TOP OF PAGE):
Nothing obligates or requires the board or authorized committee to take action against an individual (offending owner).
ENFORCEMENT POLICY AND FINE SCHEDULE, B. ENFORCEMENT GUIDELINES:
“The Board has the discretion to determine the time interval after which the continued existence of a violation may be treated as a separate new violation.” This also provides too much power to the board to levy fines and the number of fines. Some fines will range from $500 to $10,000 and there is no definition for “Health and Safety” for the $500 – $10,000 fines. This section also lacks a fine schedule to describe what action might trigger a $500 fine versus a $1,000, $5,000 or $10,000 fine. The new rules can be found on the http://www.lapalmeneighbors.com/advice website or on TownSquare at https://app.townsq.io/w/5a9d959b8fb286558f1dbed2/alerts/announcements?alertId=6a9734af8d58e03050da6b2e&source=list
If you would like to sign the petition, please contact Jorge Romero-Lozano at this email or by phone at 415-218-7592. After September 25, 2026, you may also contact Richard Detert at richard.detert@yahoo.com We need original signatures.
Kind regards,
Jorge -
